REAL ESTATE FOR SALE ON BIDS
Gabriele Grunig, Personal Representative of the Estate of Dieter Grunig, offers for sale the following described real estate located in the Townships of Poplar Grove, Huss, Stokes, Moose, and Skagen in the County of Roseau, State of Minnesota.  

PARCEL #1:
Poplar Grove Township Real Estate:

The South Half of the South Half (S½ S½) of Section Two (2), Township One Hundred Fifty-nine (159) North, Range Forty-one (41) West, according to the United States Government survey thereof, Roseau County, Minnesota, subject to easements, reservations and restrictions of record or in existence, EXCEPTING THEREFROM the following described parcel, to-wit:

A strip of land four (4) rods wide, being thirty-three (33) feet wide on each side of the center of the line of road or highway as the same now is located and established in, over and across the South Half of the South Half (S½ S½) of Section number two (2), in Township One Hundred Fifty-nine (159) North, of Range Forty-one (41) West of the Fifth Principal Meridian.

The North Seven Hundred Thirty-one (731) feet of the Southeast Quarter of the Southeast Quarter (SE¼ SE¼) of Section Fourteen (14), Township One Hundred Sixty-one (161) North, Range Forty-two (42) West of the Fifth Principal Meridian in Minnesota, according to the United States Government Survey thereof lying Westerly of the former Trunk Highway #11 as it existed prior to 1956.  (Containing 8.19 acres more or less, subject to easements and reservations of record.)*  
This parcel taking into consideration the exception described above contains 46.81 acres more or less.*  (Contains 6 Morton steel buildings – 2 separate steel buildings each measuring approximately 60’x300’ which have 18’ sidewalls with concrete floors; 3 connected steel buildings, the first measuring approximately 60’x152’ with an 18’ sidewall and concrete floor; the second measuring approximately 60’x300’ with a 30’ sidewall and concrete floor; the third measuring approximately 60’x306’ with an 18’ sidewall and concrete floor.  The sixth building measuring approximately 60’x120’ with a 24’ sidewall has a spur track running through it.  The spur track with rails embedded in concrete includes a manual transfer switch which allows loaded rail cars to be transferred onto the Minnesota Northern Railroad for shipment.

The Northeast Quarter of the Southwest Quarter (NE¼ SW¼) and the Northwest Quarter of the Southeast Quarter (NW¼ SE¼) of Section Fourteen (14), Township One Hundred Sixty-one (161) North, Range Forty-two (42) West, according to the United States Government survey thereof, Roseau County, Minnesota, subject to railroad right-of-way of record and subject to a reservation in the State of Minnesota to all minerals and mineral rights therein.
Containing 78.95 acres more or less.*   (39 open acres, more or less; 36 wooded acres, more or less; and 0.95 acre, more or less of road/ditch, and a large Morton steel building that measures approximately 60’x348’.  This building, except a gravel portion 25’± in width by 125’± in length, has a concrete floor.)  [Parcel #7 also includes a Morton steel building measuring approximately 60’x120’ which is located mostly on an adjoining parcel of real estate not owned by Dieter Grunig’s estate and therefor it encroaches on a portion of Parcel #7.  This matter is intended to be resolved by negotiation with the owner of the adjoining parcel or, the District Court may be requested to assist in resolving this issue.]

That part of the Southeast Quarter of the Southeast Quarter (SE¼ SE¼) of Section Fourteen (14), Township One Hundred Sixty-one (161) North, Range Forty-two (42) West of the Fifth Principal Meridian in Minnesota, according to the United States Government Survey thereof, described as follows:   The South Four Hundred Fifty-six (456) feet of the North Seven Hundred Thirty-one (731) feet of said SE¼ SE¼ lying Westerly of the former Trunk Highway #11 as it existed prior to 1956; subject to easements, reservations and restrictions of record.

Containing  5.72 acres more or less.*  (Including house, garage and wooded area.  The house contains approximately 1,140 square feet on the main floor, and a mostly unfinished basement, 2 bedrooms and 1½ baths, attached garage is approximately 24’x24’.


REAL ESTATE EASEMENTS MAY BE RESERVED

At Seller’s option, access easements may be reserved in order to provide legal access to adjoining parcels of land.  

The bidding for Parcels #1, #2, #3 and #4 shall be in accordance with the following time schedule (Central Standard Time) on Tuesday, March 11, 2014:

Parcel #1 – Poplar Grove Township – 9:00 a.m.
Parcel #2 – Huss Township – 9:30 a.m.
Parcel #3 – Stokes Township – 10:00 a.m.
Parcel #4 – Moose Township – 10:30 a.m.

Bidding for the 7 parcels located in Skagen Township shall commence at 1:00 p.m., on Tuesday, March 11, 2014, in accordance with the following time schedule (Central Standard Time):

Parcel #5 – 1:00 p.m.
Parcel #6 – 1:30 p.m.
Parcel #7 – 2:00 p.m.
Parcel #8 – 2:30 p.m.
Parcel #9 – 3:00 p.m.
Parcel #10 – 3:30 p.m.
Parcel #11 – 4:00 p.m.

With respect to the sales of all of said real estate, sealed bids will be accepted at the Law Offices of Patrick D. Moren, located at 309 Third Street Northwest, Roseau, Minnesota, 56751, until Tuesday, March 11, 2014, in accordance with the time schedules more fully described above, at which location and time all bids shall be opened and considered (use parking lot at rear of law office).  

Each envelope containing a bid must include in the upper left-hand corner the parcel number, name, address and telephone number of the bidder.  Bidders desiring to bid on more than one parcel shall submit a separate bid for each parcel.  

Those bidders submitting the five (5) highest bids for each respective parcel shall have the opportunity to increase their bids orally following the bid opening.    

Each parcel shall be bid separately as an entire parcel unit and not by the acre.  

The real estate taxes due and owing for the year 2014 on each parcel shall be prorated to the date of closing.

The Seller reserves the right to reject any and all bids, to waive any irregularities, and/or to negotiate a private sale.    

The sales are for cash and each successful bidder must furnish 5% of the purchase price as earnest money and enter into a Purchase Agreement on or about Tuesday, March 11, 2014.   

All parcels of real estate, including land and buildings, are being sold “AS IS”.

* All statements of acreage more or less, are based upon information obtained from Roseau County Courthouse offices.  Said parcels have not been the subject of certified surveys.  

All parcels described above are subject to any mineral reservations previously reserved, and are further subject to all easements, reservations and restrictions of record.

Sales of all parcels in each of the described townships is subject to approval and confirmation of the District Court for the Ninth Judicial District, Roseau County, Minnesota, and each Purchase Agreement entered into will include language indicating that the respective sales must be approved and confirmed by said District Court.  Failure of the District Court to approve and confirm a sale will result in the subject Purchase Agreements being rendered null and void, and in such event, the earnest money paid by the affected bidder shall be refunded.  

Following Court approval and confirmation of sales Seller will be entitled to reserve a reasonable time to remove personal property from real estate.


PERSONAL PROPERTY ALSO TO BE SOLD

An older grain elevator building situated on land leased from BNSF Railway Co., located in the City of Badger on County Road #2 (University Avenue) on the Northwesterly side of the railroad tracks.

Offers to purchase the grain elevator building may be submitted to Law Offices of Patrick D. Moren at any time prior to 4:00 p.m., Tuesday, March 11, 2014, and any sale of said elevator building will be subject to the approval of the District Court.  Each envelope containing an offer to purchase the elevator building must include in the upper left-hand corner the word “elevator” and the name, address and telephone number of the offeror.
