The Kittson County Board of Commissioners met, pursuant to adjournment on Tuesday, July 21, 2015 at 9:00 a.m.  All members were present.
The meeting was called to order by Chairman Bouvette.  The pledge to the flag was given.
The agenda was approved as presented.
A motion was made by Commissioner Olson, seconded by Commissioner Younggren and unanimously carried to approve the minutes from the July 7, 2015 County Board meeting as presented.
Meeting with the County Board was Cindy Adams with the Kittson County Historical Society.  Adams presented the Society’s 2016 proposed budget which included a request for $1,725 in additional county funding.  She added that the Society is running out of space and has started looking into the possibility of adding another building.  Funding for any expansion would come from a gift from the Curtis Miller estate and not from the County.
A motion was made by Commissioner Younggren, seconded by Commissioner Spilde and unanimously carried to approve the payment of Commissioner Warrants and Auditor Warrants as follows:

Meal Reimbursements: $135.05

Meeting with the County Board was Neil Juhnke of PICO Northstar Hallock, LLC and Harold Weimer representing CHS, Inc.  Juhnke announced that the canola plant near Kennedy had been sold to CHS Hallock, LLC, a subsidiary of CHS, Inc. effective August 1, 2015.  Juhnke asked that the existing Business Subsidy Agreement and tax abatement be transferred to CHS Hallock, LLC in accordance with the terms of the agreement.
A motion was made by Commissioner Younggren and seconded by Commissioner Anderson to adopt the following resolution: #15-18
AUTHORIZING THE ASSIGNMENT OF 
NORTHSTAR AGRI INDUSTRIES BUSINESS SUBSIDY AGREEMENT
WHEREAS, on December 20, 2011 the County of Kittson, Minnesota (“County”) entered into a Business Subsidy Agreement with PICO Northstar Hallock, LLC (“Company”); and
WHEREAS, Section 1 of the Business Subsidy Agreement specified the terms of a tax abatement to be granted by the County of Kittson, Minnesota; and
WHEREAS, Section 1.6 of the Business Subsidy Agreement specifically states that “The abatement may not be transferable to a transferee of the property without written consent of the County.  Such consent shall not be unreasonably withheld.”; and
WHEREAS, Section 3.3 of the Business Subsidy Agreement further states that “The Company may assign its rights and obligations under and pursuant to this Agreement but only with the prior, written consent of the County, which consent shall not be unreasonably withheld.” and
WHEREAS, the assets of PICO Northstar Hallock, LLC have been sold to CHS Hallock, LLC; and
WHEREAS, the owners of PICO Northstar Hallock, LLC are requesting that the County assign its rights and obligations to CHS Hallock, LLC. in according to the terms of the agreement; 
THEREFORE, BE IT RESOLVED, by the Board of County Commissioners of the County of Kittson, Minnesota that the request to assign the rights and obligations of the existing Business Subsidy Agreement, including the tax abatement, to CHS Hallock, LLC. be approved effective August 1, 2015.

Voting in favor: Commissioners Anderson, Bouvette, Olson, Spilde, and Younggren.
Voting against: none.
Meeting with the County Board was Dr. Mary Ann Sens with the University of North Dakota and Kenny Hultgren, Kittson County Sheriff.  Dr. Sens discussed the Minnesota Legislature’s new permission and notification laws for performing autopsies.  She added that the new requirements might cause her to increase her staff which could cause rates to go up in the future.
Committee reports were given.
A motion was made by Commissioner Anderson and seconded by Commissioner Spilde to adopt the following resolution: #15-19
ADOPTING A SUPPLEMENTAL BUDGET AND ESTABLISHING 
APPROPRIATIONS WITHIN THE 2015 BUDGET
WHEREAS, the Board of Commissioners adopted the fiscal year 2015 Budget on December 4, 2014; and
WHEREAS, because of unplanned events, the Board of Commissioners of Kittson County have determined that it is necessary to adopt a supplemental budget, establishing the following additional appropriation; and
WHEREAS, the additional requirements were not anticipated at the time of the budget preparation for fiscal year 2015; and
WHEREAS, there is no tax and thus no categorization of a tax involved with this Supplemental Budget; 
NOW THEREFORE BE IT RESOLVED that the Board of County Commissioners of Kittson
County hereby adopts the Supplemental Budget for fiscal year 2015 as shown below; and the amounts for the fiscal year beginning January 1, 2015 shown below are hereby amended as follows:

Explanation: to budget for new furniture for the remodeling of the Sheriff’s Department.  Source of funding for this appropriation is existing fund balance committed for capital purchases.

Voting in favor: Commissioners Anderson, Bouvette, Olson, Spilde, and Younggren.
Voting against: none.
A motion was made by Commissioner Olson, seconded by Commissioner Spilde and unanimously carried to approve a county-owned surplus property sale for the week of August 24 – 28.
Meeting with the County Board was Kelly Bengtson, Kittson County Highway Engineer, to update the Board on maintenance issues and road conditions around the County.  The bridge on CSAH 4 is open for traffic while projects on CSAH 14 and in Thompson Township are underway.  The department is putting together an Americans with Disabilities Act (ADA) transition plan to determine the quantity of sidewalks and pedestrian ramps on county highways located within municipalities. This information will be submitted with future Federal Aid projects.  The sign truck is back in service after repairs.  FEMA Flood plain maps should be finalized by 2016.
A motion was made by Commissioner Olson and seconded by Commissioner Spilde to approve hiring Knife River Materials to overlay 4,000’ of CSAH 7 west of Halma for $73,920 pending receipt of a second quote.
Meeting with the County Board was Kathy Johnson, Kittson County Social Services Director.  Johnson asked the County Board for permission to hire a second child protection worker with the additional $75,000 a year in state funding.  The funding is for 2 years and the employment beyond the 2 years would be contingent on continued state funding.  She added that some modification of the office space might be required and that those costs might be covered with the state funding as well.
A motion was made by Commissioner Spilde, seconded by Commissioner Anderson and unanimously carried to approve advertising to hire an additional child protection worker contingent on available state funding to pay for the position.
The 2nd quarter 2015 financial summary reports were received for information.
The County Board took a short recess and reconvened at the Caribou Grill to meet with Department of Natural Resources Commissioner Tom Landwehr and staff.  

Topics discussed were the elk herd conservation plan, food plots and predation, Lake Bronson Dam repairs, the Klondike water retention project, Roseau River impoundment channel project, the Fargo/Moorhead diversion project, and buffer strips along legal ditches.
The Board adjourned to August 4, 2015 at 9:00 a.m.
