CITY OF EAST GRAND FORKS OFFICAL SUMMARY OF ORDINANCE NO. 20, 4th Series AN ORDINANCE OF THE CITY OF EAST GRAND FORKS, MINNESOTA, AMENDING CITY CODE CHAPTER 33 ENTITLED “FINANCE AND TAXATION” BY ADDING SECTION 33.03 to 33.14 AND BY ADOPTING BY REFERENCE CITY CODE CHAPTER 1 AND SECTION 10.99 WHICH, AMONG OTHER THINGS, CONTAIN PENALTY PROVISIONS. The following is the official summary of Ordinance No. 20, 4th Series. A printed copy of this ordinance is available for inspection by any person at the office of the city clerk during normal business hours or on the city website at Section 33.03 declares the authority the City had to implement with sales tax by holding an election, receiving support of the community, and having the request approved by the State Legislature. Section 33.04 lists the definitions used within the ordinance. Section 33.05 states there was going to be a 1% sales and use tax from retail, storage, use, distribution, or consumption of goods or services when taxable. Section 33.06 states the sales and use tax shall be listed and charged separately from the sales price and at what amounts the tax would be collected. Section 33.07 states those that are exempt from paying taxes would be also exempt from the local sales tax. Section 33.08 states it shall be presumed that retail sales for delivery in the city are for storage, use or other consumption in the city until the contrary is established. Section 33.09 explains when the tax should be collected and remitted to the State Commissioner of the Revenue Department. Section 33.10 explains when the Commissioner may be able to deem an agent of retailer. Section 33.11 states the sales tax will go into effect on January 1, 2018. Section 33.12 declares the collection and enforcement of this local sales tax is subject to the same interests, penalties, and other rules of the State’s general sales tax. Section 33.13 explains a license may not be renewed for trade or business if the applicant is delinquent on submitting their sales and use tax. Section 33.14 lists the penalties for this ordinance and that this ordinance numbered Ordinance No. 20, 4th Series.
